New Delhi: The Union Cabinet on Friday cleared the Muslim Women (Protection of Rights on Marriage) Bill, 2017 to practice Instant ‘Triple Talaq’ a Criminal offenses.
The Islamic practice, men are allowed to “divorced” wife by stating Talaq (divorce) three times.
The Instant Triple Talaq or Talaq-e-Biddat involves Muslims, men to divorcing their wives by stating Talaq three times at once.
The proposed bill is said to be a three-year jail sentence along with fine and says that the offense will be cognizable and non-bailable.
Under the proposed ‘Muslim Women (Protection of Rights on Marriage) Bill, 2017’, a “victim” of Talaq-e-Biddat in the proposed law has the right to maintenance from her husband before a Magistrate’s Court. He will be entitled to custody of his children, says the draft law.
According to the proposed law, the victim of instant divorce can file a complaint with the police and go to the magistrate for the maintenance from her husband along with her young children.
As per this law Triple Talaq in any form, the written form or by electronic means such as email, WhatsApp or SMS will be banned.
According to the draft bill sent to the states, Triple Talak was made a cognizable and non-bailable offense, which would attract a three-year prison period.
The draft law was prepared by an inter-ministerial team chaired by Home Minister Rajnath Singh. additional member comprise Foreign Minister Sushma Swaraj, Finance Minister Arun Jaitley, Law Minister Ravi Shankar Prasad and his junior ministry, PP Chaudhary.
