New Delhi: The Supreme Court on Tuesday, while misusing the law on a large scale, said that the arrest of the accused under the Scheduled Castes / Scheduled Tribes, SC/ST (Prevention of Atrocities) Act and the accused are entitled for anticipatory bail. The bench by Adarsh K. Goel and Uday U. Lalit gave this ruling on Challenging the decision of a High Court on the appeal of Subhash Mahajan, he said that the FIR has been refused to c quash the FIR for his adverse remarks against the SC employee.
The court said that in the last three decades, as there is a need to provide safeguards against the registration of FIR and arrest under the SC/ST Act. The Bench said that this act was enacted to protect the deprived against any atrocities. At the same time, the bench said act cannot be converted into a charter for exploitation by police for external reasons against any other unscrupulous person or other citizens. The Bench said that in this act, the constitutional values of the integration of community and society should be promoted and there will be no consequence that casteism should be maintained which should adversely affect the integration of society.
