New Delhi: The Indian judiciary entered the undisputed area when Rajya Sabha Speaker M. Venkaiah Naidu dismissed the impeachment motion against Chief Justice of India Dipak Mishra, presented by seven opposition parties, immediately after which the Congress party decided to challenge Vice President’s Order in the Supreme Court.
The Congress will actually trigger an unprecedented crisis in the judiciary when their petition challenging the order of Mr. Naidu will be accepted. The demand for the conference is that the CJI does not listen to the matter itself and the next senior most judge who is in this case, Justice J. Chelameswar listen to it. The Justice Chelameswar is one of the four judges who had organized a press conference in January on the problems faced by the Supreme Court, of which Chief CJI was acting as the master of the roster.
The Rajya Sabha Speaker Mr. Naidu, who had consulted with top legal and constitutional experts including former chief justices and judges, before making the decision, the Supreme Court had rejected the motion on Monday morning, citing lack of adequate ability in it.
In a tough response, senior lawyer and Congress leader Kapil Sibal, who is one of the main architects of the proposal, said: “We will definitely file a petition in the Supreme Court.
