New Delhi: The Two accused in the Kathua rape case have strongly opposed in the Supreme Court for transfer of the trial in Chandigarh Court from Kathua court. The father of an eight-year-old girl had demanded to move the case to ensure a free and free trial.
That the accused Opposing against the transfer of trial outside the Kathua court, two accused Sanji Ram and Vishal Jagotra said that they have been falsely implicated in the case bas the accused 1 and 5 which are pending before Chief Judicial Magistrates Kathua, where the charge sheet is already filed. The petitions filed by father of the victim Mohammad Akhtar, The applicant accused are directly affected if the trial is shifted outside Kathua without making them parties to the writ petition.
The investigation of the state police, they said that the investigation should be fair, transparent and justified and the investigation agency cannot be allowed to punish and conduct biased investigation. The complainant’s facility cannot be the sole idea of transferring the criminal case from the state. The courts will have to consider the accused, the prosecution witnesses and the convenience of the larger interests of the society.
The case had already begun and there is no apprehension from the complainant for any danger or forcibly of the prosecution witnesses. They prayed for a direction to be impeded in the writ petition.
Meanwhile, through the investigating officer of Kathua rape, the Jammu and Kashmir government said that on that day when the crime branch reached the court to present the charge sheet with the accused, members of Kathua Bar Association raised slogans and shouted slogans asked the police to return.
