New Delhi: The Five Judicial Constitution Bench was formed on Monday in the Supreme Court to hear a petition moved by two Congress MPs challenging the rejection of the impeachment notice against the Chief Justice of India Dipak Misra by Rajya Sabha Speaker M. Venkaiah Naidu. A list of businesses for the Supreme Court revealed that on Monday, a bench, comprising Justices AK Sikri, SA Bobde, NV Ramana, Arun Mishra and AK Goel, will be heard in the petition. The Justice Sikri, who will lead the bench, seniority list has six numbers; others follow him in the sequence of seniority.
That, it is important that the matter is not listed before the judges who are two to five members in seniority. These judges, Justice J. Chelameswar, Ranjan Gogoi, MB Lokur and Kurian Joseph had organized a controversial press conference on January 12 in which they had revolted almost against the CJI allegation against them. Earlier, on that day senior advocate Kapil Sibal, who was one of the signatories of impeachment notices in the Rajya Sabha, had mentioned the matter for immediate listing before the senior justice J. Chelameswar, the senior-most after Chief Justice of India Dipak Misra.
