New Delhi: The Rajasthan government felt a shock; the Supreme Court stops the order of the High Court on the issue of quota law, preventing any action or decision from the state on the administrative side or in any way for the benefit of the reservation, which will result in reservations of more than 50 percent.
The Chief Justice Dipak Misra and Justice A.M. Khanwilkar and D.Y. Chandrachud, A three-judge bench, while hearing the appeal filed by the Rajasthan government against the order of the High Court, on November 13 said that it will pass order soon.
That, in its order uploaded on Wednesday, the bench said, “In our ideology, the order passed in the bill by the High Court is totally unacceptable and therefore, that part of the imputed order has stopped. Keeping in view the facts and circumstances and the various decisions of this court, we prohibit the State Government from taking any action or decision on the administrative side or they can fulfill the benefits of reservation, which is the result of crossing the reservation of more than 50 percent. “The Bench said,” As we want to send this matter to the High Court, the direction shall remain in force till the writ petition is finally disposed of. This instruction will continue till the special leave petition, accordingly is disposed of. There shall be no order as to costs.
The order of the Rajasthan High Court was stayed to prevent the state government from implementing the provision of reservation for OBCs from 21 to 26 percent, so that the Gujjars, who is agitating for reservation, can be benefited. The bill was passed on October 26, to provide reservation to Gujjars and four other wandering communities in government jobs and educational institutions, to create ‘the most backward’ category within OBC.
